Terms of Service

These Terms of Service ("Terms") govern your use of the Tingles ASMR: Relax & Sleep mobile application (the "App") and our website at asmrpress.com (the "Site"), operated by InitiateHub Ltd ("we," "us," or "our"), trading as Tingles ASMR.

By using the App or Site, you agree to these Terms. If you do not agree, please do not use our services.

1. Service Description

Tingles ASMR: Relax & Sleep is an ASMR content platform featuring sound playback, ASMR videos, podcasts, user-generated sound mixes and playlists, community features, and optional premium features. All core content is available for free without advertisements.

2. Accounts

Certain features require authentication through Google or Apple sign-in. You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

3. User-Generated Content

By uploading or sharing content (including mixes, playlists, and community posts), you grant InitiateHub Ltd a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the App and related services.

You retain ownership of your content but are responsible for ensuring it does not violate any laws or third-party rights. We reserve the right to remove any content that violates these Terms.

4. Subscriptions & Payments

Tingles ASMR Pro is available as an optional monthly or annual subscription that unlocks premium features including Sleep Mode, Smart Mix, and other enhanced features. All core content remains free regardless of subscription status.

Apple App Store (iOS)

  • Payment will be charged to your Apple ID account upon confirmation of purchase.
  • The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
  • Subscriptions can be managed and auto-renewal can be turned off in your Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Google Play Store (Android)

  • Payment will be charged to your Google Play account upon confirmation of purchase.
  • The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Subscriptions can be managed and auto-renewal can be turned off in Google Play Store > Subscriptions after purchase.

Refund requests should be directed to the respective app store (Apple or Google) through their standard refund process.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Upload content that is harmful, offensive, or infringes on others' rights
  • Interfere with the App's operation or other users' experience
  • Create multiple accounts for abusive purposes

6. Third-Party Content

The App provides access to ASMR videos and podcasts hosted on third-party platforms (such as YouTube). We do not claim ownership of this content and it is subject to the respective platform's terms of service.

7. Disclaimer of Warranties

The App and Site are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.

ASMR content is intended for relaxation and entertainment purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid to us in the last twelve (12) months, or one hundred dollars ($100), whichever is greater.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
